01Acceptance of the Terms

By creating an Inktally account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you accept on behalf of an organisation, you represent that you are authorised to bind it.

02Eligibility & Account Registration

You must be at least 16 years old and provide a real email address you control. You are responsible for safeguarding your master password — because of our zero-knowledge design, we cannot reset it for you (see clause 6).

03Description of the Service

Inktally is an end-to-end encrypted vault for documents, notes, and credentials, paired with a release mechanism that delivers chosen materials to chosen recipients on conditions you define. We may add, change, or remove features over time.

04Subscription, Fees & Billing

Paid plans are billed in advance via our payment processors (Stripe and Razorpay). Fees are stated at checkout and exclusive of taxes unless noted. We do not delete your content for non-payment; you simply lose the ability to add content above the free-plan limits.

05Your Content & Vault

You retain all rights to the content you store. You grant Inktally only the limited licence needed to store, transmit, and (on your instruction) release it. You are responsible for the legality of what you store.

Decoy vaults

Inktally supports an optional decoy vault: a second passphrase unlocks a separate, plausible vault. We will never confirm or deny to any third party — including under legal compulsion — whether a given account has a decoy vault, because the design makes it impossible for us to know. You alone control whether one exists.

06Encryption, Keys & Recovery

In zero-knowledge mode, your master key is derived from your password on your device (Argon2id) and never reaches our servers, which see only ciphertext. If you lose your password and have not configured recovery contacts, we cannot recover your vault. This is the deliberate trade-off of zero-knowledge encryption.

07Recipients, Triggers & Release

You decide what is released, to whom, and when — via fixed dates, inactivity (dead-man's-switch), executor action, or manual release. A cooling-off period (default 48 hours) lets you reverse a release before it is claimed. Once claimed after the period elapses, a release is final.

08Acceptable Use & Prohibited Conduct

You may not use Inktally to store or distribute unlawful material, infringe others' rights, attempt to breach the Service's security, or use it to harass or harm. We may act on credible reports of abuse consistent with our zero-knowledge constraints.

09Intellectual Property

Inktally and its marks are our property. Our cryptography core and offline-decryption reader are released under their stated open-source licences; nothing here restricts your rights under those licences.

10Disclaimers & Limitation of Liability

The Service is provided “as is” without warranties of any kind to the maximum extent permitted by law. To the extent permitted by applicable law, Inktally's total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the fees you paid in the twelve (12) months preceding the claim, or (b) INR 10,000.

11Indemnification

You agree to indemnify Inktally against third-party claims arising from your content, your use of the Service in breach of these Terms, or your violation of applicable law.

12Suspension & Termination

You may close your account at any time; deletion completes within 30 days, though audit logs required for integrity may survive. We may suspend or terminate access for material breach, with notice where practicable.

13Governing Law & Jurisdiction

These Terms are governed by the laws of India, and the courts at Bengaluru, Karnataka have primary jurisdiction. Nothing in this clause deprives you of the protection of mandatory consumer law in your place of residence: residents of the EEA, the UK, Australia, Canada, Singapore, the UAE, and the United States retain the rights and forums their local law guarantees.

14Changes, Notices & Miscellaneous

We may update these Terms; material changes will be notified by email or in-product with reasonable advance notice. If any provision is held unenforceable, the rest remains in effect. These Terms are the entire agreement between you and Inktally regarding the Service.
